1. About the website

HiTradies.com lets you access software and services that help operate your business. The site is operated by HiTradies Business Management Pty Ltd (ABN 61 686 484 873).

By browsing or using the website or related services, you acknowledge that you have read, understood, and agree to these terms. If you do not agree, you must stop using the site immediately. We may update the terms at our discretion, and changes take effect upon publication. Keep a copy for your records.

2. Acceptance of the terms

You accept the terms by remaining on the site. Where applicable, you may also click to accept. Your continued use after updates constitutes acceptance of the revised terms.

3. About the service

HiTradies provides different account types and software tools that may evolve over time. Additional account-specific terms or a Software Licensing Agreement may govern how certain features work. Those terms supersede these terms where they conflict.

We reserve the right to change account offerings, features, or requirements. We will let you know when special conditions apply so you can review and accept them before using those features.

4. Acceptable use

Use the website and services lawfully and respectfully. HiTradies may suspend, restrict, or terminate access if you misuse the platform. Prohibited conduct includes:

  • Modifying, disabling, or otherwise compromising performance or availability.
  • Overwhelming infrastructure with unreasonable load or traffic.
  • Testing or probing systems without written permission.

  • Phishing, spoofing, impersonating others, or misrepresenting affiliations.
  • Accessing services through unsupported interfaces or contrary to licensing agreements.

If a payment request is returned or denied, you are responsible for associated costs, including banking fees. Updated pricing takes effect after the current subscription ends.

9. Refund policy

We provide refunds in accordance with Australian Consumer Law and as outlined in these terms. If we can no longer provide the services or determine that a refund is reasonable, we will return the unused portion of the subscription fee.

11. General disclaimer

Nothing in these terms limits rights that cannot be excluded under law, including Australian Consumer Law. Subject to that:

  • All guarantees, warranties, or representations not expressly stated are excluded.
  • We are not liable for special, indirect, or consequential loss (including lost profits or opportunities) arising from your use of the services, unless such loss is reasonably foreseeable because we failed to meet a consumer guarantee.

Use the site at your own risk. The services are provided as-is without warranty. We are not responsible for errors, outages, harmful components, loss of data, unlawful third-party conduct, or unauthorized access to records. We also do not guarantee the accuracy or currency of site content or third-party links.

12. Limitation of liability

Our total liability arising from the services or these terms is limited to resupplying the services. HiTradies, its affiliates, employees, agents, contributors, and licensors will not be liable for direct, indirect, incidental, or exemplary damages, including any loss of profit, goodwill, or reputation.

13. Termination

Either party may terminate these terms. You may terminate by not renewing your subscription, giving notice of termination, and closing your accounts. We may terminate if you fail to renew, breach the terms, break the law, or if providing the service is no longer commercially viable.

Subject to local laws, we may suspend or cancel your subscription or account at any time without notice if you breach the terms or if your conduct harms our reputation or others' rights.

14. Indemnity

You agree to indemnify HiTradies, its affiliates, employees, agents, contributors, third-party content providers, and licensors against any claims, liabilities, losses, or expenses arising from:

  • Content you submit or actions you take on the website.
  • Direct or indirect consequences of accessing or using the services.
  • Any breach of these terms.

15. Dispute resolution

Except where urgent relief is required, disputes must follow this process before either party starts tribunal or court proceedings:

  • Provide written notice detailing the dispute, desired outcome, and required actions.
  • Work in good faith to resolve the dispute within 28 days of the notice.
  • If unresolved, jointly appoint a mediator (or request one be appointed) and share mediation costs equally. Each party covers its own additional expenses.
  • Hold mediation in the Australian Capital Territory (ACT). Communications are confidential and treated as without-prejudice discussions.
  • If mediation has not resolved the dispute within two months, either party may ask the mediator to terminate the process.

16. Venue and jurisdiction

The services are intended for Australian residents. Any dispute arising from the website must be resolved exclusively in the courts of the ACT.

17. Governing law

These terms are governed by the laws of Australia. All disputes or claims related to the terms will be interpreted according to Australian law without reference to conflict-of-law principles. The terms bind the parties and their successors and assigns.

18. Severance

If any portion of these terms is deemed void or unenforceable by a competent court, that portion will be severed and the remainder will remain in full force.
